Terms of Service — WICKVIPER

Rules for using the website, Telegram channels and VIP subscription: nature of the content, payment, withdrawal, complaints and liability.

In short: WICKVIPER is an educational trading community. We publish general information and setups, the same for everyone. We do not know your financial situation and we do not tell you what to do with your money. Trading CFDs, forex and gold with leverage can end in the loss of all the capital you invest. We do not promise profits. VIP access is bought for a fixed period and does not renew automatically.

§ 1. Who provides the services

  1. The services are provided by the operator of the WICKVIPER service (the "Operator"), contact: [email protected] and the official Telegram bot @WickViperBot.
  2. The Operator is not an investment firm, a brokerage house, an investment adviser or a crypto-asset service provider, and is not authorised by any financial supervisor. It does not provide services that require such authorisation, in particular investment advice, portfolio management, or receiving and executing orders.

§ 2. Definitions

  • Service: the wickviper.com website and its language versions.
  • Channels: the WICKVIPER channels and bot on Telegram (free channels and the VIP channel) and our social media profiles.
  • User: a person using the Service or the Channels. Subscriber: a User who has bought VIP access.
  • Consumer: a natural person entering into a contract not directly related to their business or profession. The consumer provisions also apply to traders as provided by Polish consumer law (Article 7aa of the Consumer Rights Act).
  • Setup: general information about a possible trading scenario (instrument, direction, entry, stop-loss, take-profit), published with the same content for everyone in a given channel.
  • Ledger: the public register of Setups and their results at wickviper.com/en/results/.

§ 3. Nature of the services: education and general information

  1. All WICKVIPER content (articles, Lab, Academy, market commentary, glossary, Setups) is educational and informational. Setups are general information addressed to everyone in a channel with the same content.
  2. The content is not investment advice or a recommendation tailored to you. The Operator does not collect information about your financial situation, knowledge, experience, goals or risk tolerance, and does not assess whether a trade is suitable for you.
  3. The Operator does not answer questions about whether a specific person should make a trade, what position size to use or what to do with their money.
  4. You make investment decisions yourself, at your own risk, with a licensed intermediary of your choice. The Operator has no access to your account and does not trade on your behalf.
  5. Past results in the Ledger are neither a guarantee nor a forecast of future results. Details: Risk Warning.
  6. The services are for adults (18+) with full legal capacity only.

§ 4. Services

  1. Free services: browsing the Service, the free Telegram channels, our social media profiles, contact by e-mail and via the bot. The contract for free services is concluded when you start using them, for an indefinite period. You can end it at any time by no longer using the Service or leaving the channel.
  2. Paid service, VIP access: access to the VIP channel on Telegram for the period of the chosen plan, counted from the moment access is granted. It includes the Setups posted in the VIP channel, commentary on them and educational material shared in the channel. The Operator does not guarantee a set number of Setups, because it depends on market conditions.
  3. VIP access is digital content supplied on Telegram.

§ 5. Technical requirements

  1. Service: a device with internet access and an up-to-date browser (Chrome, Firefox, Safari or Edge).
  2. Channels: a Telegram account, subject to Telegram's terms.
  3. Payment: a crypto wallet that supports the token and network shown by the bot.
  4. The Service uses no cookies (Cookie Policy).

§ 6. Plans, prices and payment

  1. The bot shows the current plans and prices before you order: VIP 30 days: USD 29, VIP 90 days: USD 79, VIP 365 days: USD 249 and, until all 20 places are taken, Founding Member 365 days: USD 149 with the same price on renewal. Prices are final prices.
  2. You pay in USDT on the TRON network (TRC-20) or in another token and network if the bot offers them. The bot gives the amount in tokens in the order.
  3. Network fees are charged by the blockchain network, not by the Operator, and are paid by the sender. The Operator charges no other fees.
  4. Payments are made only to the wallet address shown by the @WickViperBot bot for the specific order. The Operator never sends a wallet address in a private message on its own initiative. A payment to any other address is not a payment to the Operator.
  5. An order is valid for the time shown by the bot (normally 30 minutes). A payment is booked once the transaction is confirmed on the network. If you pay too little, access is not granted and, at your request, the Operator returns the amount received to the address you give on the same network within 14 days. Overpayments are returned on the same terms. The Operator pays the network fee for the refund.
  6. Access does not renew automatically. Before the period ends, the bot may remind you that you can extend it.
  7. The Operator may change the prices of future periods. A change does not affect periods already paid. Whenever a price reduction is announced, the Operator states the lowest price from the 30 days before the reduction.

§ 7. Concluding the contract

  1. You place an order in the @WickViperBot bot. Before you order, the bot shows the description of the service, the price, the access period, the fact that access does not renew automatically, the payment method and links to the Terms, the Privacy Policy and the Risk Warning.
  2. When ordering you confirm: your country of residence; that you are 18 or over; that you accept the Terms; that you request supply of the digital content immediately after the payment is booked and acknowledge that you lose the right of withdrawal once supply begins (§ 10). You then press the "Order with obligation to pay" button.
  3. The contract is concluded when you press that button. The bot sends a confirmation of the contract with the Terms version, your country and the wording of your consent. Keep that message.
  4. Once the payment is booked, the bot grants access to the VIP channel (a one-time invite link or approval of your join request).

§ 8. End of access

  1. Access expires at the end of the paid period and is then removed automatically.
  2. The Operator may terminate the contract with immediate effect if a Subscriber seriously breaches § 9 (in particular by sharing VIP content with third parties, defrauding other Users or impersonating the Operator), after first asking them to stop, unless asking would be pointless. The Operator then refunds the part of the price for the unused period.
  3. If the Operator can no longer provide the service (e.g. it ceases operating or Telegram permanently blocks the channel), it refunds the part of the price for the unused period.

§ 9. Community rules

  1. It is forbidden to: a) post unlawful content, including content that infringes the rights of others, misleads or incites hatred; b) advertise brokers, platforms, "signals", crypto projects or other services, including by private message to members; c) impersonate the Operator, or ask others for money, login details, private keys or access to accounts; d) copy, resell or publish VIP content outside the VIP channel (including screenshots); the content is protected by copyright, and personal use is allowed; e) promise profits or urge others to make specific trades; f) spam, use bots or scrape content.
  2. The Operator never writes first to ask for a payment, never asks for passwords or seed phrases, and never offers to manage your money, "recover losses" or "double profits". Any such message is a scam. Report it to [email protected].
  3. If these rules are breached, the Operator may remove content, warn the User, block them from the free channel or apply § 8(2).

§ 10. Right of withdrawal (Consumers)

  1. A Consumer may withdraw from a distance contract within 14 days of concluding it, without giving a reason.
  2. The right of withdrawal lapses once the Operator, at the Consumer's express request made before payment (§ 7(2)) and after informing them that they would lose this right, has begun supplying the digital content, i.e. has granted access to the VIP channel, and the Consumer has received the confirmation of the contract (Article 16(m) of Directive 2011/83/EU; Article 38(1)(13) of the Polish Consumer Rights Act).
  3. Until access has been granted, you can withdraw by sending a statement to [email protected] or to the bot. You may use the model withdrawal form, but you do not have to. The Operator refunds the payment within 14 days, in the same token and on the same network, to the address you give. The Operator pays the network fee for the refund.

§ 11. Complaints

  1. If the service does not work as agreed (e.g. no access to a paid channel), write to [email protected] or to the bot. Give your Telegram username, the transaction hash, a description of the problem and what you request.
  2. The Operator replies within 14 days of receiving the complaint. If it does not reply in that time, the complaint is deemed accepted.
  3. If the digital content does not conform to the contract, you have the rights provided by consumer law: first, bringing it into conformity, and if that is impossible, ineffective or not done within a reasonable time, a price reduction or termination of the contract.
  4. Dissatisfaction with the result of a Setup is not a complaint. Setups can end in a loss, as the Risk Warning explains, and their results are published in the Ledger.

§ 12. Liability

  1. The Operator is liable for providing the services properly in line with these Terms and the law, including for the conformity of the digital content with the contract.
  2. The subject of the service is the supply of educational content and general Setups, not the achievement of any financial result. The Operator is not liable for the result of trades a User decides to make, or for brokers, exchanges, wallets and blockchain networks.
  3. If an outage of Telegram or of providers beyond the Operator's control prevents use of the VIP channel for more than 24 hours, the Operator extends access by the length of the outage.
  4. This section does not limit liability towards Consumers where the law forbids it, nor liability for damage caused intentionally.

§ 13. Security

Using the internet and crypto carries risks: phishing, fake accounts impersonating WICKVIPER, sending funds to the wrong address or network (funds may be lost for good) and malware. Check the bot name (@WickViperBot) and the website address (wickviper.com).

§ 14. Intellectual property

WICKVIPER content (texts, graphics, logo, Setups, educational material) is protected by copyright. You may use it for personal purposes. Quoting with attribution and a link is allowed within the limits of the right of quotation. Any other use requires the Operator's consent.

§ 15. Personal data

How we process data is described in the Privacy Policy.

§ 16. Changes to the Terms

  1. The Operator may change the Terms for good reasons: changes in the law, a decision or guidance from an authority, changes to the scope or manner of the services, changes to payment methods, changes to the terms of Telegram or other providers, or the need to ensure security.
  2. The Operator announces changes in the Service and in the Channels at least 14 days before they take effect.
  3. Paid access periods are performed under the terms in force when the contract was concluded, unless a change is solely in the Subscriber's favour.
  4. The current version applies to free services. If you do not accept the changes, you can stop using them.

§ 17. Governing law and final provisions

  1. Polish law applies to contracts. This choice of law does not deprive Consumers of the protection of the mandatory rules of the country where they habitually reside (Article 6(2) of Regulation (EC) No 593/2008, "Rome I").
  2. Disputes with Consumers are settled by the courts with jurisdiction under general rules.
  3. The Terms are available free of charge in the Service in a form that can be saved and printed.
  4. The Terms were drawn up in Polish; other language versions are translations. In case of discrepancy, the version more favourable to the Consumer applies.
